1.About these Terms and the agreement they form
These Terms of Use ("Terms") govern your access to and use of the website located at www.onecompare.co.za (the "Website"), and the services we make available through it (together, the "Services"), provided by OneCompare (Pty) Ltd, an authorised Financial Services Provider (FSP 55551) authorised by the Financial Sector Conduct Authority (FSCA) under the Financial Advisory and Intermediary Services Act, 2002 ("FAIS").
By accessing the Website or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Website or the Services. These Terms constitute a binding agreement between you ("you", "your", "the User") and OneCompare (Pty) Ltd ("we", "us", "our", "OneCompare").
These Terms apply to the current version of the Website and Services. The version published here at the time of your visit governs your use of the Website and Services on that occasion.
2.What OneCompare does — and what we do not do
OneCompare is a car insurance comparison service. We help South African drivers compare cover and pricing across multiple insurers, and we offer a free policy review service. The following clarifications are important and apply to everything else in these Terms:
2.1We primarily act as an intermediary
OneCompare primarily acts as an intermediary as defined in FAIS. We are not the party that pays your claim. The insurance contract you enter into is a direct contract between you and the insurer of your choice, and that insurer is the party responsible for assessing risk, accepting cover, and settling claims.
2.2We do not collect premiums
OneCompare does not collect, hold, or administer premiums on behalf of any insurer or policyholder. All premium payments are made directly by you to the insurer of the policy you have taken out, in accordance with that insurer’s own collection arrangements.
2.3Quotes are indicative until confirmed by the insurer
Any quotation displayed on the Website or sent to you is indicative, based on the information you provided and the information our partner insurers have made available. The premium and cover terms are not binding on any insurer until that insurer has carried out its own underwriting assessment and issued a policy schedule to you. The insurer may decline to offer cover, may offer cover on different terms, or may amend the premium after assessing your risk.
2.4We carry Professional Indemnity insurance
In accordance with the FAIS Act and the FSCA Conduct Standards, OneCompare maintains Professional Indemnity and Fidelity insurance appropriate to its category of FSP authorisation.
3.Eligibility
To use the Services, you must:
- Be at least 18 years of age and have the legal capacity to enter into binding contracts in South Africa.
- Reside in or be otherwise lawfully present in the Republic of South Africa, and require insurance for a vehicle registered or to be registered in South Africa.
- Provide accurate, current, and complete information when you use the Services.
- Use the Services only for your own personal, non-commercial purposes, except where you are using them as a representative of a juristic person you are authorised to bind.
4.How the comparison and policy review services work
4.1Comparison
When you submit a quote request through our Website, we transmit the information you have provided to the insurance partners we have selected as appropriate to your profile. Each partner that wishes to provide a quotation will do so on the basis of its own rating model and its own assessment of the information available to it.
4.2Free policy review
Our free policy review service compares your existing policy (where you have provided your current schedule) against alternatives available in the market. The review is intended to help you understand whether your current cover and pricing remain appropriate. It does not, on its own, constitute personal financial advice in the meaning of FAIS.
4.3No obligation to take up a quote
You are under no obligation to take up any quotation or recommendation generated through the Services. The decision to enter into any insurance contract is yours alone.
4.4No fee charged to you
The Services are provided to you free of charge. OneCompare earns its income through commercial arrangements with the insurance partners on our panel. Those arrangements are disclosed in our Conflict of Interest Management Policy.
5.Your obligations when using the Services
When you use the Services, you agree that you will:
- Provide information that is true, accurate, complete, and up to date. You acknowledge that an insurer is entitled to decline cover, decline a claim, or void a policy where material information is found to be incorrect or omitted.
- Not impersonate any other person or use another person’s personal information without their authorisation.
- Not use the Website or the Services for any unlawful, fraudulent, or harmful purpose.
- Not attempt to gain unauthorised access to any part of the Website, the underlying systems, or any account or data that does not belong to you.
- Not use any automated means (including bots, scrapers, or harvesters) to access the Website without our prior written consent, except for standard search-engine indexing.
- Not introduce or transmit any virus, malware, or other harmful code through your use of the Website.
- Respect the intellectual property rights set out in section 7.
6.Personal information and the law
Your use of the Services involves the processing of your personal information. The way we collect, use, share, and protect that information is governed by our Privacy Policy, which forms part of these Terms.
You confirm that any personal information of third parties (for example, additional drivers) which you provide to us is provided with that person’s knowledge and authority. Where required by the Protection of Personal Information Act, 4 of 2013 ("POPIA"), you must obtain the consent of that person before providing their information to us.
7.Intellectual property
7.1Ownership
All content on the Website — including text, images, graphics, logos, trademarks, software, and the compilation of the foregoing — is owned by OneCompare or its licensors, and is protected by South African and international intellectual property law. The OneCompare name, logos, and other distinctive marks are unregistered or registered trademarks of OneCompare.
7.2Limited licence to you
We grant you a non-exclusive, non-transferable, limited and revocable right to access and use the Website and its content for your own personal, non-commercial purposes in connection with the Services. This licence does not allow you to reproduce, modify, distribute, publicly display, sell, sublicense, or otherwise commercially exploit any of our content, whether for your own benefit or for the benefit of any third party, without our prior written consent.
7.3No grant of any further right
Except as expressly set out in this section, nothing in these Terms grants you any right, title, or interest in any of OneCompare’s intellectual property.
8.Third-party content and links
The Website may contain links to third-party websites or display third-party content (for example, insurer logos and product descriptions). We provide these for your convenience and information only.
OneCompare does not endorse, control, or accept responsibility for the content, availability, or accuracy of any third-party website or product. Your dealings with any third party are entirely between you and that third party, and are subject to that party’s own terms and conditions.
9.Availability of the Services
We will use reasonable efforts to keep the Website and Services available, but we do not guarantee that they will be available at all times, that they will be free of errors or interruptions, or that they will be compatible with all devices and browsers.
We reserve the right to suspend, modify, or discontinue any aspect of the Website or the Services at any time, with or without notice, including for maintenance, security, or business reasons.
10.Disclaimers, limitations, and consumer rights
10.1The Services are provided on an “as is” basis
Except as expressly stated in these Terms, the Website and the Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, OneCompare does not give any warranty, condition, or representation — whether express or implied — that the Website or the Services will be uninterrupted, error-free, fit for any particular purpose, or that any information obtained through them will be accurate, current, or complete.
10.2Limitation of liability
To the maximum extent permitted by law, neither OneCompare nor its directors, employees, agents, or partners will be liable to you for any indirect, incidental, special, consequential, or punitive loss or damage arising out of or in connection with your use of the Website or the Services, including but not limited to loss of profit, loss of business, loss of data, or loss of goodwill.
Where any liability cannot be excluded by law, OneCompare’s total aggregate liability for any direct loss or damage arising out of or in connection with the Website or the Services will be limited to R10,000 (ten thousand Rand).
10.3Your statutory rights are preserved
Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under the Consumer Protection Act, 68 of 2008 ("CPA"), the Electronic Communications and Transactions Act, 25 of 2002 ("ECTA"), or other applicable law. Where a provision of these Terms purports to limit or exclude such liability, that provision must be read down to the extent permitted by law and the rest of these Terms will remain in force.
10.4No liability for insurer conduct
OneCompare is not liable for any act or omission of any insurer, including the decision to decline cover, decline a claim, or void a policy. Your remedies in respect of any insurer’s conduct lie against that insurer, including through the National Financial Ombud Scheme for South Africa.
11.Indemnity
You agree to indemnify and hold harmless OneCompare, its directors, employees, agents, and partners from and against any claim, loss, liability, cost, or expense (including reasonable legal fees) arising out of:
- Your breach of these Terms.
- Any information you provide that turns out to be inaccurate, misleading, or fraudulent.
- Your unauthorised use of the Website or the Services.
- Your breach of any law in connection with your use of the Website or the Services.
This indemnity will not apply to the extent that any claim, loss, liability, cost, or expense arises from OneCompare’s own gross negligence or wilful misconduct.
12.Electronic communications and signature
You consent to receive communications from OneCompare by electronic means (email, SMS, WhatsApp, or in-app notification, where applicable), and you agree that any such communication will satisfy any legal requirement that communication be in writing.
Where you complete a form on the Website, click a button labelled "I agree" or similar, or otherwise take an electronic action intended to indicate your agreement, that action constitutes your electronic signature for the purposes of section 13 of the Electronic Communications and Transactions Act, 25 of 2002, and is binding on you to the same extent as a handwritten signature.
13.Complaints and the Ombud
We take complaints seriously and we have a documented complaints process in line with the FAIS General Code of Conduct and applicable Policyholder Protection Rules.
13.1Complain to us first
If you have a complaint about the Services or your interaction with OneCompare, please first send full details by email to legal@onecompare.co.za. We will acknowledge your complaint within five business days and will work to resolve it within the timeframes set out in our complaints policy.
13.2External recourse
If your complaint is not resolved to your satisfaction, you may refer it to:
- The National Financial Ombud Scheme for South Africa (which incorporates the former Ombudsman for Short-Term Insurance and other ombud schemes), in respect of complaints against financial services providers and insurers. Website: https://nfosa.co.za. Email: info@nfosa.co.za.

14.Suspension and termination of access
We may suspend or terminate your access to the Website and the Services at any time, with or without notice, if we reasonably believe that:
- You have breached these Terms or any applicable law.
- Your use of the Website or the Services is creating a security, technical, or legal risk to us, our partners, or other Users.
- You have provided information that is materially false, misleading, or incomplete.
Sections of these Terms that by their nature should survive termination (including sections 6, 7, 10, 11, 12, 15, 16, and 17) will continue to apply after termination.
15.Changes to these Terms
We may amend these Terms from time to time. The current version is always published on the Website with the "Last updated" date shown at the top. By continuing to use the Website or the Services after a change has been published, you accept the updated Terms. Where the changes are material, we will draw them to your attention through a clear notice on the Website or by direct communication where appropriate.
16.General provisions
16.1Governing law and jurisdiction
These Terms are governed by the laws of the Republic of South Africa. You and OneCompare submit to the non-exclusive jurisdiction of the South African courts in respect of any dispute arising out of or in connection with these Terms.
16.2Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be severed from these Terms to the minimum extent necessary, and the remainder of these Terms will continue in full force and effect.
16.3No waiver
A failure or delay by OneCompare to enforce any right under these Terms is not a waiver of that right. A single or partial exercise of any right does not preclude any further exercise of that or any other right.
16.4Assignment
You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms to any successor in title or to any group company, without your consent, provided that the assignee will be bound by these Terms.
16.5Entire agreement
These Terms (together with our Privacy Policy and Conflict of Interest Management Policy) constitute the entire agreement between you and OneCompare in respect of the Website and the Services, and supersede any prior agreement, representation, or understanding.
